As the academic semester comes to a close for many of us, a new day in employment law is dawning for people who identify as transgender or gender non-conforming. The EEOC has ruled that gender identity discrimination is tantamount to gender discrimination. This - for the first time - provides federal protections in employment for those who face discrimination for identifying as transgender or gender non-conforming. The EEOC relied heavily on a report - Injustice at Every Turn - by the National Center for Transgender Equality and the National Gay and Lesbian Task Force in its decision. The report revealed a staggering amount of employment discrimination for those who identified as transgender, particularly people of color who also identified as transgender.
